Monday,
July 12, 2010
The Mayor
and Board of Aldermen met in regular session on Monday, July 12, 2010 at 6:00
p.m. in the City Hall with the following members present:
Mayor
Raymond Gunter
Alderman
William Allen
Alderman Eddie Barnett, Jr.
Alderman
Paul Barkley
City Clerk
Randall Baker was present and performed the duties of his office.
City
Attorney Mike Mowrer was present as legal counsel for the City.
Mayor
Raymond Gunter called the session to order and requested a roll call.
Approval
of minutes
Motion was
made by Alderman Barnett and seconded by Alderman Allen to approve the minutes
of the June 14, 2010 regular session.
Motion carried unanimously.
Motion was
made by Alderman Barnett and seconded by Alderman Barkley to approve the minutes
of the June 14, 2010 closed session.
Motion carried unanimously.
Motion was
made by Alderman Allen and seconded by Alderman Barnett to approve the minutes
of the June 28, 2010 special session.
Motion carried with three yes and Alderman Barkley abstaining as he was
not present at the special session.
Motion was
made by Alderman Barnett and seconded by Alderman Allen to approve the minutes
of the June 28, 2010 closed session upon the correction of “Motion was made by
Alderman Grubbs and seconded by Alderman Barkley to return to open session.
A roll call vote was taken with Alderman Barnett voting yes, Alderman
Barkley voting yes, Alderman Grubbs voting yes and Alderman Allen voting yes.”
To “Motion was made by Alderman Barnett and seconded by Alderman Grubbs to
return to open session. A roll call
vote was taken with Alderman Barnett voting yes, Alderman Grubbs voting yes and
Alderman Allen voting yes.” Motion
carried with three yes and with Alderman Barkley abstaining as he was not
present at the special session.
Payment of
bills
Motion was
made by Alderman Allen and seconded by Alderman Barnett to allow payment of the
monthly bills. Motion carried
unanimously.
Alderman
Grubbs present at meeting
Alderman
Gary Grubbs responded to the roll call as present at 6:15 p.m.
Mary
Bevel-Water line on Highway 53 South
Mary Bevel
addressed the Council concerning a broken water main servicing the water supply
to her property, which is outside the city limits.
She asked the Council if she was responsible for the cost of the repair
for the main. City Clerk Randall
Baker explained to her that he had done research and the city had always paid to
fix those lines in the past and would continue to do so.
Ordinance
setting minimum fine for pit bull dog inside city limits
The
following bill was then introduced and read.
BILL NO.

ORDINANCE NO. 687
AN
ORDINANCE AMENDING ORDINANCE NUMBER 600 OF THE CITY OF CAMPBELL, MISSOURI
PROHIBITING CERTAIN DOGS IN ORDER TO CHANGE THE PUNISHMENT.
WHEREAS, it is in the public’s interest that said Ordinance Number 600 be
amended.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CAMPBELL,
MISSOURI AS FOLLOWS:
Section 1.
Section 2.
Punishment of Ordinance No. 600 is deleted and in its place a new Section 2
is inserted as follows:
Section 2.
Punishment. The owner
or keeper of any of the above defined dogs found within the city limits of the
City of Campbell shall be punished by a fine of Five Hundred Dollars ($500.00)
and may be jailed for up to ninety (90) days or both.
Additionally, the dog or dogs shall be immediately confiscated by the
Animal Control Officer of the City.
If a violation of this Ordinance continues, each day’s violation shall be deemed
a separate violation.
Section 2.
Conflicting Ordinances Repealed.
All Ordinances or parts of Ordinances in conflict herewith are repealed.
Section 3.
This Ordinance shall be in full force and effect upon its passage,
approval and adoption.

July, 2008.
Read the second time, passed and approved this 12th day of July,
2008.

Motion was
made by Alderman Barnett and seconded by Alderman Allen that the Bill be placed
upon a second reading. Motion
carried unanimously.
Motion was
made by Alderman Grubbs and seconded by Alderman Barkley that the Bill pass and
become Ordinance Number 687. Motion
carried unanimously.
Police
Officers instructed on zero tolerance for pit bull dogs
Alderman
Barnett reported that he had met with police officers about the matter of pit
bull dogs inside the city limits and informing them of the zero-tolerance for
the pit bull dogs. He explained to
the officers that identifying the pit bulls should be left up to the court and
not the officer.
Sale of
property at 512 Central Avenue
Motion was
made by Alderman Barkley and seconded by Alderman Grubbs to offer for sale the
city owned property located at 512 Central Avenue and more fully described as
the south sixty feet of lot 4 block 8 Forrest Hill Addition with a minimum bid
of $2500.00. Motion carried
unanimously.
Sale of
1997 Ford pickup
Motion was
made by Alderman Barnett and seconded by Alderman Barkley that bids be solicited
for the sale of the Street Department 1997 Ford F-250 pickup truck.
Motion carried unanimously.
Sunshine
Law reviewed
At this
time Mayor Gunter spoke to the Board about the Sunshine Law and asked the City
Attorney to review the law with the Council.
City Attorney Mike Mowrer gave the Council an overview of the Law and
discussed many of the rules for closed session.
Closed
Session
Motion was
made by Alderman Allen and seconded by Alderman Barnett to go into closed
session to discuss matters as allowed under section 610.021, RSMo and those
matters only. A roll call vote was
taken with Alderman Barnett voting yes, Alderman Barkley voting yes, Alderman
Grubbs voting yes and Alderman Allen voting yes.
After
returning to open session the minutes reflect personnel matters were discussed.
In other
open session business the following action was taken.
Steve
Williams increase in pay
Motion was
made by Alderman Grubbs and seconded by Alderman Allen to approve an increase in
pay of $.75 per hour for Wastewater Department Superintendant Steve Williams
retroactive to the June 28, 2010 payroll ending date.
Motion carried unanimously.
Rondal
Fisher increase in pay
Motion was
made by Alderman Grubbs and seconded by Alderman Barnett to approve an increase
in pay of $1.00 per hour for Water Department Superintendant Rondal Fisher
effective July 9, 2010. Motion
carried unanimously.
Rinda
Williams increase in pay
Motion was
made by Alderman Barkley and seconded by Alderman Barnett to approve an increase
in pay of $1.00 per hour for police department employee Rinda Williams
retroactive to the June 21, 2010 payroll ending date.
Motion carried unanimously.
Po Boys
donation
Motion was
made by Alderman Allen and seconded by Alderman Barnett to donate $250.00 to the
Po Boys Softball Day in the city park.
Motion carried unanimously.
Treat
property 1117 East Haynes Street
Motion was
made by Alderman Grubbs and seconded by Alderman Barnett to pay the inspection
fee by Smith and Company for the property at 1117 East Haynes Street to allow
the fire department to use the structure for a fire burning exercise provided
the shingles are first removed by the property owner.
Motion carried unanimously.
Authorize
bank account signature card change
Motion was
made by Alderman Barnett and seconded by Alderman Barkley approving the change
of the authorized signatures on the City of Campbell checking account number
000051 with First Community Bank to Mayor Raymond Gunter, City Treasurer Jim
Lawrence and City Clerk Randall Baker with Deputy City Clerk Nikki Brooks being
authorized to sign Randall Baker’s name as city clerk, with her initials noted,
in the absence and at the direction of the City Clerk.
Motion carried unanimously.
Loans
combined
Motion was
made by Alderman Allen and seconded by Alderman Barkley approving the combining
of First Community Bank loans numbers 71548 and 72451 and to secure that
combined loan with certificate of deposit number 116575 and to extend the loan
to May, 2011 upon First Community Bank’s agreement.
Motion carried unanimously.
Vacate
portion of Wilson Street
Motion was
made by Alderman Grubbs and seconded by Alderman Barkley instructing the City
Attorney to prepare an Ordinance to vacate a portion of Wilson Street off
Speedway Street. Motion carried
unanimously.
Adjournment
Motion was
made by Alderman Barnett and seconded by Alderman Allen to adjourn.
Motion carried unanimously.
